TERMS AND CONDITIONS OF SERVICE
TERMS AND DEFINITIONS
Service provider - UAB "Evitra LT", company code 302617964, VAT code LT100006911614, address Laisvės Ave 60-601, Vilnius, Lithuania LT-05120.
Customer - an individual or legal entity booking transfers or making another order for renting a vehicle with a driver from the Service Provider.
Transfer - transportation of at least one passenger from the specified point of departure to the selected destination. The transfer service includes: meeting at the place of order with a name plate, loading / unloading luggage into the vehicle, transportation of the passenger (s) to the destination.
Rules - official conditions for the provision of transport services by the Service Provider to the Customer.
1. GENERAL PROVISIONS
1.1. By agreeing to the Rules, the Customer thereby confirms that he has read the provisions for the provision of passenger transportation provided by the Service Provider;
1.2. These Rules apply to the carriage of passengers by passenger cars, minivans, minibuses on charter flights on routes within the territory of the Republic of Latvia and international traffic.
1.3. The Service Provider undertakes to ensure the safe transportation of passengers and baggage on the requested route.
1.4. The transport offered by the Service Provider is classified by class. The customer chooses the transport according to his needs. The service provider provides standard, comfort, business and premium class transport.
2. BOOKING AND PAYMENT
2.1. The customer must be of legal age;
2.2. Form of payment: prepayment through the site through payment systems, bank transfer, credit card, payment by card to the driver, cash payment to the driver in euro currency. The form of payment is established by agreement.
2.3. The service provider retains the right to charge a full prepayment: long-distance trips, trips longer than 8 hours, non-standard orders.
2.4. Booking is carried out online on the website, using a phone call, SMS, e-mail;
2.5. The customer must fill in all the required fields in the booking form and then confirm the order. When filling out the request form, indicate the data: name, surname, contact phone number, e-mail address, date of the planned trip, route, departure time, flight number, number of passengers and other preferences;
2.6. By providing all the data, the Customer is fully responsible for their accuracy. The Service Provider is not responsible for incorrectly entered or false information;
2.7. To complete the reservation, the Customer is obliged to pay a deposit or the full amount of the order or confirm, as agreed, the form of payment with the Service Provider;
2.8. In the event of an error in the Customer's contact details, local arrival/departure time or destination address, this error will be considered the fault of the Customer. The Service Provider retains the right to demand compensation for the rental of vehicles based on incorrect data provided by the Customer. All compensation from the Service Provider is not provided;
2.9. When refunding money, the Service Provider does not compensate bank charges and financial institutions, compensating only the amount of the order;
2.10. The Service Provider does not compensate for the banking and other expenses incurred by the Customer.
2.11. If the Customer needs an invoice, he provides the Service Provider with the details and all the necessary data on the day of the order. The Service Provider undertakes to provide an invoice within one business day. 2.12. When paying in cash to the driver, the driver issues a receipt for payment in accordance with applicable laws.
3. OBLIGATIONS AND RIGHTS OF THE CUSTOMER
The customer has the right:
3.1. Use the passenger transportation service for which a preliminary payment or the entire amount of the order has been made;
3.2. Carry luggage in accordance with the procedure established by the Service Provider, the amount and type of luggage must be specified in advance by the Customer;
3.3. Submit an application for the return of the amount paid if the Customer cancels the trip no later than 6 hours before the start of the trip by car, no later than 7 days before the start of the order by minibus, bus; The customer undertakes:
3.4. When filling out the request form, indicate the data: name and surname of the customer; name or name for meeting passengers when ordering a transfer; contact phone number of the customer and passenger, email address, date of the planned trip, route, departure time, flight number, number of passengers, number of children and other preferences;
3.5. Submit an order for the carriage of passengers no later than 5 hours before the start of the trip;
3.6. Notify the Service Provider of any changes not previously specified in the request;
3.7. Warn the Service Provider about a possible delay no later than one hour before the start of the trip;
3.8. Pay all additional costs (rental of child car seats, extra luggage, overtime hours of vehicle rental, downtime, additional costs for a parking space in paid parking lots, additional mileage, damage to the vehicle or its devices due to the fault of the Customer);
3.9. Do not interfere with the driver during the order to drive the vehicle;
3.10. Adhere to all safety rules during the trip;
3.11. Pay for the use of services before the end of the rental of transport. In the case of a long trip, payment is charged on the first day of the trip, or by agreement with the client in advance;
3.12. Use the vehicle for its intended purpose, do not damage it, do not drink alcohol during the trip, do not smoke in the cabin, do not leave garbage;
3.13. Compensate the Service Provider for damage if the vehicle or its devices were damaged due to the fault of the Customer;
3.14. When traveling abroad, carry a valid passport, visa, insurance and not carry any illegal goods or other prohibited items;
3.15. Warn the Service Provider if the Customer does not find the driver at the appointed place at the appointed time.
4. OBLIGATIONS AND RIGHTS OF THE SERVICE PROVIDER
The service provider has the right:
4.1. Ask the Customer to pay an advance fee or the full amount of the order before the trip;
4.2. In case of non-receipt of an advance payment or full payment before the date agreed in advance, do not provide this service and cancel the pre-order;
4.3. If the Customer cancels the order later than 24 hours before the start of the trip by car, a fine of 30 percent of the order amount will be charged; later than 7 days before the start of the trip by minibus / bus, charge a fine in the amount of 30 percent of the order amount; later than 48 hours before the start of the minibus / bus trip, charge a fine of 50 percent of the order amount;
4.4. Do not provide services during the trip if the Customer does not agree to negotiate the amount with the Service Provider and pay for additional services: rent of child seats in the car, extra luggage, extra time for renting a vehicle, downtime, additional costs for a parking space in paid parking lots, additional mileage, damage to the vehicle or its devices due to the fault of the Customer;
4.5. Not to provide services and not to return the advance payment or the full amount of the order if the Customer does not properly comply with its obligations to the Service Provider, is in a state of intoxication or poses a danger to others;
4.6. Do not wait for the Customer at the starting point of the route, if the Customer is late for 60 minutes or more and otherwise agreed with the Customer. If the Customer does not appear within the specified time and it is not possible to contact him, it is considered that the trip did not take place due to the fault of the Customer and advance payment, the full amount of the order is not refundable;
4.7. Disembark the passenger and not provide further services if the passenger is carrying illegal goods or other prohibited items and immediately report the information to the police.
4.8. Do not return the paid amount of the order to the Customer if the Customer did not use the services of the Supplier and did not warn about it in advance. The Service Provider undertakes:
4.9. Provide technically sound transport for trips on the indicated route(s) with a driver;
4.10. Have the necessary documents (technical passport, driver's license, technical inspection document, insurance policies, etc.);
4.11. In the event of a breakdown of the vehicle, immediately eliminate the malfunction, and if this is not possible, send another vehicle of the same class within the agreed time;
4.12. In case of being late for 30 or more minutes, or providing services in another improper way, provide a discount for contractual services;
4.13. In case of being late for an hour or more and without notifying the Customer in advance, non-arrival due to the fault of the Service Provider at the agreed place, return the amount of the advance payment, the entire amount of the order to the Customer; 4.14. Obey all traffic rules.
5. CONDITIONS OF CARRIAGE OF BAGGAGE
5.1. The Customer is obliged to inform in advance about the amount and type of baggage carried, so that the Service Provider can choose the best car option for the transfer;
5.2. If the Customer arrives at the transfer with an additional piece of baggage without notifying the Service Provider in advance, the Service Provider reserves the right to charge a fee for excess baggage or refuse to provide further services without refunding compensation or the amount of the order in case of lack of space in the car;
5.3. All passengers and their baggage are insured in accordance with the existing vehicle insurance policy and the rules of the insurance companies.
6. OTHER TERMS
6.1. During the trip, the Service Provider is not responsible for things and material values left in the vehicle, however, it does everything possible and dependent on the driver to ensure the safety of passengers' property;
6.2. The Service Provider bears full responsibility for the damage caused by its actions or inaction to the Customer, including its passengers, and reimburses the Customer for the damage;
6.3. The Service Provider guarantees complete confidentiality of the Customer's data;
6.4. If you are traveling with a partner of the Service Provider, the conditions for the carriage of passengers and baggage, as well as the rules for the behavior of the client in the car remain the same;
6.5. Service prices are valid at the time of their publication on the website and may be changed by the Service Provider.
6.6. The Service Provider provides services in accordance with the current legislation of Latvia.
